1. Eligibility: MEN7 & COBY Electronics Presents "The Mummy: Tomb of the Dragon Emperor” Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least thirteen (13) years old at the time of entry. Employees of Universal Studios Home Entertainment, LLC (“Universal”), COBY Electronics Corporation, matrixx, Men7, LLC and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members (whether related or not) of each such employee are not eligible. Subject to all applicable federal, state and local laws and regulations and void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsors’ and Administrator’s (as defined below in #2) decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsors: COBY Electronics Corporation, 1991 Marcus Avenue, Suite 301, Lake Success, NY 11042 and Men7, LLC, 2032 Armacost Ave, Los Angeles, CA 90025. Administrator: matrixx, 3122 Santa Monica Blvd, Santa Monica, CA 90404.
3. Timing: The Sweepstakes begins on or about 12:01 a.m. Eastern Time ("ET") on 11/19/08 and ends at 6:00 p.m. ET on 1/10/09 (the "Promotion Period"). Administrator’s computer is the official time keeping device for this Sweepstakes.
4. How to Enter: During the Promotion Period, go to http://www.coby-electronics.com/men7/ (“Website”) and fill out the registration form. Complete and submit the registration form including a valid home address. P.O. Boxes are not permitted. You automatically will receive one (1) entry into the Sweepstakes for that day. All potential winners are subject to verification before any prize will be awarded. Administrator is responsible for the functionality of the Sweepstakes. Limit: Each participant may receive one (1) entry per day for the Sweepstakes during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's plays/entries and that entrant may be disqualified.
Use of any automated system to participate is prohibited and will result in disqualification. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
Participant email will be added to the email lists (“Opt-in”) of both Sponsors and may be contacted about future promotions, products & services (“Future Email”). Participant may unsubscribe at any time to the individual Sponsors’ list by following the instructions at the bottom of any such Future Email.
5. Sweepstakes: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of potential winners are final and binding in all matters related to the Promotion. The Grand Prize winner will be randomly selected from all eligible entries received throughout the Promotion Period. Three weekly (3) prize winners will be randomly selected from all eligible entries received between the start of the Promotion Period and 6:00 p.m. ET of each of the following drawing dates: 11/21/08, 11/28/2008, 12/05/2008, 12/12/2008, 12/19/2008, 12/26/2008, 1/2/2009 and 1/10/2009; for a total of twenty-four (24) weekly prize winners One (1) Grand Prize Winner will be selected on/about 1/10/09 from among all eligible entries.
6. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSORS OR ADMINISTRATOR AND WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY, AND/OR THE SWEEPSTAKES WINNER HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
7. Verification of Potential Winners: Potential winners must continue to comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. The potential winners will be notified by email, telephone, or registered mail after the date of drawing. A potential Grand Prize winner (parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to Sponsor, within ten (10) days of the date notice or attempted notice is sent, a notarized Affidavit of Eligibility, Liability & Publicity Release in order to claim the Grand Prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period (if applicable), the potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. There will be two (2) alternate drawings for an applicable weekly prize, and up to five (5) alternate drawings of the Grand Prize, in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, such prize may go unawarded.
8. Prizes: ONE (1) GRAND PRIZE: A Trip to Universal Studios Hollywood. Trip package (the “Grand Prize”) includes roundtrip, coach-class air transportation for four (4) people from a major airport near winner’s home (determined by Sponsor in its sole discretion) to Los Angeles International Airport; four (4) days and three (3) nights accommodations determined by Sponsor in its sole discretion (single standard room, quadruple occupancy, room and tax only); four (4) 2-Day Front of Line Passes to Universal Studios Hollywood theme park and a DVD of The Mummy: Tomb of the Dragon Emperor (“Mummy DVD”). Approximate Retail Value ("ARV") of the Grand Prize: $2,499.
TWENTY-FOUR (24) WEEKLY PRIZES: COBY Electronics Products. Each weekly prize will be determined by Sponsor in its sole discretion, but may include, without limitation, such COBY Electronics products (the “Weekly Prize”) as portable MP3/MP4 Video Players, Portable DVD Players, Digital Photo Frames, Home Theatre Systems and HD Radios. Each Weekly Prize will also be shipped with a Mummy DVD. ARV of each Weekly Prize: $100.00.
Grand Prize Winner: Winner must complete the trip within one (1) year from the Sweepstakes end date or prize will be forfeited. Trip must be booked at least sixty (60) days prior to departure. All elements of the Grand Prize must be redeemed at the same time, and no changes will be permitted upon confirmation. Trip is subject to availability and blackout dates. Travel must be roundtrip. Winner and guests must travel at the same time and must depart from the same city. Sponsors will determine airline and flight itinerary in their sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsors’ airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Minor traveling companions, if any, must be accompanied by parent or legal guardian. If winner is a minor in his/her state of residence, travel companion must include winner’s parent/legal guardian. Travel companions (or Grand Prize winning parent or legal guardian if travel companion is minor child or ward of Grand Prize winner) must execute travel companion liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if any portion of the prize trip is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. Actual values may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value.
Odds of winning a Weekly Prize or the Grand Prize depend on the number of eligible entries received. Limit: One (1) prize awarded per winner.
For All Prizes: No cash equivalent and all prizes are non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsors reserve the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. The total ARV of all of the prizes to be awarded in the Sweepstakes is approximately $4,899.00.
9. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsors, Administrator, Universal and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees, shareholders and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.
10. Publicity: Except where prohibited, acceptance of a prize constitutes winner’s consent to Sponsors’ and their respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
11. General Conditions: Sponsors reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsors in their sole discretion. In such event, Sponsors reserve the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsors reserve the right, in their sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsors, in their sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.
13. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for California provided however, claims for bodily injury, personal injury, or property damage arising out of the redemption, use, or misuse of the Grand or Weekly Prizes must be submitted to the jurisdiction and venue of the federal and state courts of the State of California, and construed and enforced in accordance with the laws of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

15. Winner List: To obtain a copy of the winners list, send a self-addressed stamped envelope to COBY Electronics, c/o matrixx/Mummy Sweepstakes, 3122 Santa Monica Blvd., Santa Monica, CA 90404. Winners list requests will only be accepted after the end of the Promotion Period and no later than 3/1/2009. These Official Rules will be posted at the Website during the Promotion Period.
